Terms of Service

1) Overview

This website and storefront (the “Site”) are owned and operated by Inscripted, LLC (“Inscripted,” “we,” “us,” or “our”). We provide customized map prints, artwork, frames, and related services (collectively, the “Services”). Our store is hosted on Shopify Inc., which provides the ecommerce platform enabling us to sell to you.

By accessing the Site, purchasing from us, or otherwise using the Services, you agree to be bound by these Terms of Service (the “Terms”), our Privacy Policy, and any additional policies referenced herein or presented at checkout. If you do not agree, do not use the Site or the Services.

We may update these Terms from time to time by posting a revised version on the Site. Changes are effective upon posting. Your continued use constitutes acceptance.

2) Eligibility & Account

You represent that you are at least the age of majority in your state or province of residence, or you are the age of majority and have given consent for any minor dependents to use the Site. You agree to provide accurate, current, and complete account and order information and to promptly update such information (including email, address, and payment details).

We may refuse, limit, or cancel orders at our discretion, including per customer, per household, or per order. We may notify you using the email/phone/billing address you provided.

3) Intellectual Property & License From You (DMCA Subsection)

If you believe material on our Site infringes your copyright, please send a written notice to the DMCA Agent including:

  1. Your physical or electronic signature.

  2. Identification of the copyrighted work claimed to be infringed.

  3. Identification of the material claimed to be infringing, and information reasonably sufficient to permit us to locate the material.

  4. Your contact information.

  5. A statement that you have a good-faith belief that the use is not authorized.

  6. A statement under penalty of perjury that you are authorized to act on behalf of the copyright owner.

4) Customization; Proofs; Color & Material Variance

  • Personalized Goods: Most products are made-to-order from your inputs (location, titles, dates, coordinates, colorways, frame options, etc.). Please review your inputs carefully. Typos, color choices, spelling, and design options you provide are produced as submitted.

  • Proofs (if provided): When we provide a digital proof, production begins after you approve. If you do not respond within the timeframe stated in the proof email (or, if none is stated, within 72 hours), we may proceed using the most recent version to avoid delays.

  • Color/Material Variation: Monitors, device settings, inks, papers (e.g., hot press, cold press, matte/pearl/velvet), frames (e.g., natural oak), and plexi can produce differences between on-screen images and final products. Minor variation in tone, texture, crop/scale, or print alignment is normal and not considered a defect.

  • Map Data & Accuracy: Our map art is decorative and not for navigation. Geographic features, place names, boundaries, and points of interest may change over time or differ by data source. Minor composition/zoom adjustments may occur to optimize aesthetic balance.

5) Products, Pricing & Availability

We reserve the right to modify or discontinue products, features, and prices at any time without notice. We may limit quantities, sales to certain regions, or refuse service in our discretion. We strive for accuracy but do not guarantee that product descriptions, images, pricing, or availability are error-free; we may correct errors (including after order submission) and cancel/refund as needed.

Unless expressly permitted in writing, all purchases are for personal, non-commercial use. Commercial use of designs produced for your order is prohibited.

6) Orders, Payment & Taxes

By submitting an order, you authorize us (and our payment processors) to charge your selected payment method for the total amount, including product(s), shipping, taxes/duties (if applicable), and any add-ons. You are responsible for any sales, use, VAT/GST, import, customs, brokerage, or similar taxes/duties not collected at checkout.

Pre-Orders / Backorders: Estimated ship windows are estimates only and may change.

7) Shipping; Risk of Loss; International

We ship to the address you provide. Title and risk of loss pass to you upon delivery to the carrier (Incoterms may vary by destination). Delivery dates are estimates. We are not responsible for delays due to carriers, customs, weather, peak seasons, or force majeure.

International Orders: You are the importer of record and responsible for compliance with local laws and for all duties, taxes, and brokerage fees. Refused packages may be returned or abandoned per carrier rules; we may deduct associated costs from any discretionary refund.

8) Returns, Cancellations & Replacements (Customized Items)

Because items are personalized and made-to-order, all sales are final and non-returnable except where required by law or where we determine a manufacturing defect or damage occurred in transit.

  • Report Issues Promptly: Inspect upon delivery. For damage/defect claims, contact support@inscriptedmaps.com within 7 calendar days with your order number, a description, and clear photos of product, packaging, and shipping label.

  • Eligible Remedies: At our discretion, we may repair, replace, or refund the affected item(s). We may require return shipping or destruction of the defective item (proof of destruction may be requested).

  • Cancellations: Orders may be canceled within 2 hours of purchase if design work/production has not begun; after that, cancellation is not guaranteed. Rush orders/proofs may begin immediately.

9) Optional Tools & Third-Party Links

We may provide access to third-party tools or link to third-party sites/services we do not control or endorse. You use them as-is and at your own risk, governed by those third parties’ terms and policies.

10) Acceptable Use & Prohibited Conduct

You agree not to: (a) violate any law; (b) infringe IP or privacy/publicity rights; (c) upload unlawful, defamatory, obscene, hateful, harassing, or discriminatory content; (d) transmit malware or interfere with the Site; (e) scrape, crawl, or harvest data without permission; (f) misrepresent your identity or affiliation; (g) circumvent security features; or (h) use the Services for any obscene/immoral purpose. We may suspend or terminate access for violations.

11) Reviews, Feedback & Submissions

If you submit reviews, ideas, suggestions, proposals, or other feedback (collectively “Feedback”), you grant us a perpetual, worldwide, royalty-free license to use, reproduce, modify, publish, translate, distribute, and display such Feedback without obligation to you. We may moderate, edit, or remove content in our discretion.

Photos via Review Requests: Photos submitted through our review prompts or Site widgets may be used in our marketing as described in Section 3 (UGC License).

12) SMS/MMS & Email Marketing Programs

By opting in (e.g., at checkout, via popup, keyword, or form), you consent to receive marketing texts and/or emails from us or our providers (e.g., Klaviyo, Postscript). Consent is not a condition of purchase. Message/data rates may apply. Message frequency varies.

  • Opt-Out (Texts): Reply STOP, END, CANCEL, UNSUBSCRIBE, or QUIT to any text. You may receive a final confirmation message.

  • Opt-Out (Email): Use the unsubscribe link in any marketing email.

  • Support: Text HELP for SMS support or email support@inscriptedmaps.com.

  • Reassigned Numbers: If your mobile number changes, opt out before reassignment to avoid messages to the new owner. You agree to indemnify us for claims arising from failure to notify us of number changes.

  • We disclaim responsibility for delays/failures in message delivery beyond our control (e.g., carrier/network issues). Participation requires a compatible device and participating carrier.

13) Disclaimers

THE SITE AND SERVICES (INCLUDING ALL PRODUCTS) ARE PROVIDED “AS IS” AND “AS AVAILABLE.” EXCEPT AS REQUIRED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND QUIET ENJOYMENT.
We do not guarantee uninterrupted, timely, secure, or error-free operation or that defects will be corrected. Information may be incomplete or outdated.

Decorative Use: Our prints are artistic and not suitable for navigation, surveying, or safety-critical uses.

14) Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL INSCRIPTED, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, CONTRACTORS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES (INCLUDING LOST PROFITS/REVENUE/GOODWILL/ DATA), ARISING FROM OR RELATED TO THE SERVICES OR PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY.

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATING TO THE SERVICES OR PRODUCTS SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT(S) GIVING RISE TO THE CLAIM IN THE 12 MONTHS PRECEDING THE EVENT.

Some jurisdictions do not allow certain exclusions/limits; in those jurisdictions, our liability will be limited to the maximum extent permitted.

15) Indemnification

You agree to indemnify, defend, and hold harmless Inscripted and our affiliates, officers, directors, employees, agents, contractors, licensors, and suppliers from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Services; (b) your User Content; (c) your violation of these Terms or law; or (d) your violation of any third-party right.

16) Dispute Resolution; Arbitration; Class Waiver

PLEASE READ THIS SECTION CAREFULLY — IT AFFECTS YOUR RIGHTS.
To the fullest extent permitted by law, any dispute, claim, or controversy between you and Inscripted arising out of or relating to these Terms or the Services shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules (or Consumer Rules, if applicable). The arbitration will be conducted in Montana (venue to be determined in accordance with AAA rules), before a single arbitrator. The Federal Arbitration Act (FAA) governs the interpretation and enforcement of this arbitration agreement.

No Class Actions: You and Inscripted agree to arbitrate solely on an individual basis. Class, collective, and representative proceedings are not permitted. The arbitrator may award relief only in favor of the individual party seeking relief.

Small Claims: Either party may bring qualifying claims in small claims court in Montana instead of arbitration.

Each party bears its own arbitration costs and attorneys’ fees, except where the arbitrator is authorized to award fees by statute or contract. Except as required by law, the parties shall keep arbitration proceedings confidential.

If any part of this Section is found unenforceable, that portion will be severed, and the remainder enforced to the fullest extent permitted by law.

17) Governing Law; Venue

These Terms are governed by the laws of the State of Montana, without regard to conflicts of law principles, and applicable U.S. federal law. Subject to the arbitration clause above, exclusive venue and jurisdiction for any permitted court action shall lie in the state or federal courts located in Montana, and you consent to personal jurisdiction there.

18) Force Majeure

We are not liable for delays or failures caused by events beyond our reasonable control, including acts of God, natural disasters, fires, floods, epidemics, wars, civil unrest, labor disputes, supply chain disruptions, carrier delays, power outages, or governmental actions.

19) Electronic Communications; Notices

You consent to receive communications electronically. We may provide notices by email, SMS, in-app messages, or by posting on the Site.

Service of process must be delivered to Inscripted, LLC’s registered agent on file with the Montana Secretary of State.

20) Severability; Waiver; Assignment

If any provision of these Terms is held unlawful, void, or unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions will remain in full force. Our failure to enforce any provision is not a waiver. You may not assign these Terms without our prior written consent; we may assign them without notice in connection with a merger, sale, or reorganization.

21) Entire Agreement

These Terms, together with the policies referenced herein (including the Privacy Policy and Returns & Replacements Policy), constitute the entire agreement between you and Inscripted and supersede prior or contemporaneous communications.
